1. Acknowledgement
1.1 By making a purchase, submitting payment, or completing a booking, you acknowledge that you have read, understood, and agreed to these Terms and Conditions, Booking Terms and Privacy Policies.
1.2 The terms “we,” “us,” and “our” refer to Kenge Village. The terms “you,” “your,” “guest,” or “client” refer to any person making a booking or staying at the property. Nothing in these Terms confers any third-party rights or benefits.
1.3 The Owners of Kenge Village reserve the right to amend these Terms and Conditions at any time, with reasonable notice provided on the website or via email.
2. Provision of Services
2.1 We make every effort to ensure that the information on our website, including photographs and descriptions, is accurate, up-to-date, and compliant with Australian Consumer Law. We reserve the right to update or modify website information at any time.
2.2 While we strive to ensure the home appears as represented online, furnishings, décor, and household items may be updated or replaced from time to time due to maintenance needs, safety requirements, or aesthetic improvements. Such changes may occur without notice, provided they do not materially alter the property’s overall standard or functionality.
3. Check In and Check Out
3.1 Check-in is available from 2:00pm. You will receive a unique gate code 2 days prior to arrival. This code will expire upon departure.
3.2 Check-out is at 11:00am. Towels should be left in the bath or shower recess. Ceiling fans may be left on low, and windows may be left open if safe to do so.
3.3 Early check-in and late check-out may be possible during low or mid-week seasons, subject to availability. The only guaranteed method is to book an extra night.
3.4 Additional cleaning charges will apply if the property is not left in a clean, tidy, and reasonable condition.
4. Occupancy
4.1 The lead guest making the booking must be at least 18 years of age and must be staying at the property for the duration of the booking
4.2 The home accommodates a maximum of 8 guests across four rooms: three rooms with king beds and one room with a queen sofa bed. No additional guests are permitted without prior written approval.
4.2 The home is rented strictly for holiday purposes only for the dates specified in the booking confirmation.
4.3 Parties, events, or functions are strictly prohibited. Breaches will incur a non-negotiable $2,500 charge and may result in immediate termination of the rental.
4.4 Pets are not permitted, except accredited assistance animals, including guide dogs, hearing dogs, or medical alert dogs.
4.5 The double garage is not included in the rental agreement.
5. Drug, Alcohol, Smoking and Vaping on the Premises
5.1 Children under 18 are strictly prohibited from consuming alcohol on the premises.
5.2 Consumption of alcohol is undertaken at your own risk. Kenge Village is not responsible for injuries or incidents arising from alcohol use.
5.3 The use or possession of illegal drugs on the premises is strictly prohibited. Breaches will result in immediate cancellation of the rental with no refund.
5.4 S moking or vaping is not permitted inside the home. These activities are allowed only in the designated outdoor area (front lawn). All waste must be disposed of safely. Additional deodorising or cleaning fees may apply.
6. Linen, Towels and Pool Towels
6.1 Kenge Village provides linen, doonas, pillows, bath towels, pool towels, bathmats, and tea towels for the number of guests booked.
6.2 At check-out, towels should be left in the bath or shower recess. Missing or damaged linen will incur replacement charges at cost.
7. Pond and Swimming Pool
7.1 The swimming pool and pond are fenced; however, children must be actively supervised by a responsible adult at all times.
7.2 Although safety measures are in place, guests use the pool, pond, and surrounding areas at their own risk.
7.3 No eating, drinking, or urinating is permitted in the pool.
7.4 No glass is permitted in the pool area.
8. Personal Items and Lost Property
8.1 Kenge Village and the owner accept no responsibility for personal items left on the premises during or after your stay.
8.2 Guests have 3 months to claim lost items. Unclaimed items will be donated to the Port Douglas Community Opportunity Shop.
8.3 Returning lost property incurs all postage or courier costs plus a $25 handling fee, payable before items are shipped.
9. Guest Behaviour and Responsibility
9.1 Guests must be considerate of neighbours and avoid excessive noise or unsociable behaviour. To respect neighbouring properties, quiet hours apply between 10:00pm and 7:00am.
9.2 Guests must treat the home with respect. Additional cleaning or damage charges apply if the property is not left in a clean, tidy, and reasonable condition, or if items are missing.
9.3 Garbage and recycling must be disposed of in the allocated bins. Garbage day is Wednesday. Guests staying 4+ days are requested to place bins on the kerb on Tuesday night.
9.4 The property must be kept secure and locked when unattended. Damage or loss caused by failure to secure the property may be charged to the guest.
10. Sale of Property and Existing Bookings
If the property is sold and a future booking cannot be honoured, the owner will use their best endeavours to secure an acceptable alternative property for the guest. If no suitable alternative is found, all payments made will be refunded in full, constituting the owner’s total liability.
11. Wildlife and Tropical Environment
11.1 Kenge Village was inspired by an African village with a Balinese influence and is designed for tropical living. For optimal comfort, we recommend opening the windows during the day (excluding the lower slats) and closing them at night if you wish to use the air conditioning. Ceiling fans may remain on low speed when the room is in use.
11.2 Kenge Village is located in a natural tropical environment. Guests may encounter native wildlife, including insects, geckos, frogs, and small reptiles, around the property. These are a normal part of tropical living, and no refunds will be offered for wildlife sightings.
12. BBQ
If the BBQ is used, it must be cleaned prior to departure. A cleaning fee will be applied for excessively dirty BBQs.
13. Parking
Guest parking is available in the driveway or on the street. The double garage is not accessible to guests.
14. Liability and Indemnity (Optional Clause)
14.1 Guests occupy the property and use its facilities at their own risk.
14.2 To the extent permitted by law, Kenge Village and the owner are not liable for:
